Terms of service

The deal
Xcobean Systems Ltd ("we") provides a hosted ERPNext service and related integrations ("the Service") to you ("the customer"). You agree to pay monthly fees per your plan and not to abuse the Service. We agree to keep it running, keep your data safe, and let you leave with all your data on request.
Plans + payment
Plans are billed monthly in advance via M-Pesa Paybill, Pesapal, or invoice. All prices exclude VAT (16%). Late payments may result in service suspension after 14 days notice. Annual prepay is available — email hello@mojaedge.com.
Acceptable use
Don't use the Service for spamming, phishing, hosting malware, illegal content, or to attack third parties. Don't reverse-engineer the Service or attempt to access other tenants' data. Don't exceed your plan's user or site limits without upgrading.
Your data
You own it. We hold it on your behalf. We back it up, encrypt it, and isolate it. On request — at any time, including after you leave — we deliver a full SQL dump + uploaded files within 24 hours at no charge.
Uptime
We target 99.9% monthly uptime on Pro and Starter plans, 99.95% on Business, and per-contract on Enterprise. Downtime credits are issued automatically against the next invoice if we breach targets. Scheduled maintenance windows (announced 7 days in advance) don't count against uptime.
Cancellation
Cancel any time with 30 days notice. Pro-rated refunds for unused days. We provide a full data export package at cancellation.
Limitation of liability
Our maximum liability to you for any claim is the fees you paid us in the 12 months preceding the claim. We're not liable for indirect or consequential losses (e.g. business interruption from third-party outages like Safaricom or KRA).
Governing law
These terms are governed by the laws of Kenya. Disputes will first go to mediation through the Chartered Institute of Arbitrators (Kenya); failing that, to the High Court of Kenya in Nairobi.
